GENERAL TERMS AND CONDITIONS OF SALE – PIXEA STUDIO

ARTICLE 1 – SELLER IDENTITY

The website https://institutdesideesactives.com is published by PIXEA STUDIO, a French SARL (Limited Liability Company) with a share capital of 7500 €, whose registered office is located at 22 rue Hirschberg, 67440 THAL MARMOUTIER, France.

ARTICLE 2 – PRODUCTS AND PRICES

The products offered are original physical creations. Prices are indicated in Euros, including all taxes (TTC/VAT included).

Shipping Fees:

  • France: Free

  • Europe: €7.50

  • International: €10.00

ARTICLE 3 – ORDERS AND PAYMENT

The customer validates their order through the "double-click" procedure (reviewing the cart, then confirming with an obligation to pay). Payment is made exclusively by credit card via the Stripe secure platform.

In the event of product unavailability after an order has been placed, PIXEA STUDIO undertakes to refund the customer or offer an exchange for a product of equivalent value.

ARTICLE 4 – RETENTION OF TITLE

PIXEA STUDIO retains full ownership of the products sold until full payment of the price, including principal and any accessories. Until such date, the customer is prohibited from reselling or transforming the products.

ARTICLE 5 – DELIVERY AND TRANSFER OF RISK

5.1 Lead Times: Given the nature of the products, delivery occurs within a period of 30 to 45 days after the expiration of the 14-day statutory withdrawal period.

5.2 Transfer of Risk:

  • B2C (Consumers): The risk of loss or damage is transferred to the customer when they take physical possession of the package.

  • B2B (Professionals): The transfer of risk occurs "Ex-Works" (EXW - Thal Marmoutier). Goods travel at the professional customer's risk from the moment they are handed over to the carrier.

ARTICLE 6 – RIGHT OF WITHDRAWAL

6.1 Consumer Customers (B2C): In accordance with the law, the customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal without having to justify their reasons.

  • Return Shipping Costs: The costs of returning the product are the sole responsibility of the customer.

  • Procedure: A withdrawal button is available on the customer account or via the contact form.

    6.2 Professional Customers (B2B): No right of withdrawal is granted to professional customers.

ARTICLE 7 – LATE PAYMENT PENALTIES (B2B ONLY)

For any late payment by a professional, penalties equal to 3 times the legal interest rate are due by right, as well as a fixed indemnity for recovery costs of €40 (Art. L441-10 of the French Commercial Code).

ARTICLE 8 – STATUTORY WARRANTIES

The seller is liable for lack of conformity (Art. L217-3 et seq. of the French Consumer Code) and hidden defects (Art. 1641 of the French Civil Code).

  • The customer has 2 years from the delivery of the goods to act under the statutory warranty of conformity.

  • In case of a defect, the customer may obtain repair or replacement of the item (subject to the cost conditions provided by law).

ARTICLE 9 – INTELLECTUAL PROPERTY

The products sold by PIXEA STUDIO are original creations protected by copyright, produced in agreement with the partner artists.

Any reproduction, copy, modification, or commercial use of the products, even partial, is strictly prohibited without the prior written consent of PIXEA STUDIO.

ARTICLE 10 – PERSONAL DATA (GDPR)

The data collected (name, address, email) are necessary for order management and billing.

With the customer's consent (opt-in), the email address may be used to send a newsletter regarding new phases of the project. The customer can unsubscribe at any time via the unsubscribe link.

ARTICLE 11 – DISPUTES AND MEDIATION

11.1 Mediation (B2C): In the event of a dispute, the consumer customer must first contact customer service at bodyinstrument@etik.com. If no solution is found, they may refer the matter to the consumer mediator [NAME OF THE MEDIATOR TO BE COMPLETED].

11.2 Competent Court: Any dispute with a professional customer shall fall under the exclusive jurisdiction of the Commercial Court of Saverne (Tribunal de Commerce de Saverne), notwithstanding multiple defendants or third-party appeals. For consumers, statutory rules of jurisdiction apply.
